520 _aThis discussion document is a part of the Ministry of Justice review process for the Domestic Violence Act (1995) and related regulations. The objective of the review is to identify any changes that would make the legislation more effective as a framework for providing legal protection to victims of domestic violence in order to prevent further violence. The authors argue that there is support for the principles and framework of the Act, and there has been no indication over the years that a more fundamental review is warranted. Therefore, the present review takes an 'issues-based' approach. The issues set out in the document have been raised in the course of initial consultation and the discussion document is provided as part of an extended consultation process calling for further submissions. An overview to the review process is provided outlining the background to the review, current violence prevention initiatives, related regulations previous reviews and the scope of the current review. Part One of the document begins with a overview of the Domestic Violence Act (1995) and the changing response to domestic violence under it. It discusses a number of proposed legislative changes relating to protection orders and their enforcement, links between the Family Court and the District Court, issues relating to children and domestic violence, and programmes for respondents to protection orders and protected persons. Part Two of the document discusses a number of proposed legislative changes relating to the interfaces between the Domestic Violence Act (1995), the Care of Children Act (2004), and the Family Proceedings Act (1980). Part Three of the document provides a list of 55 questions under consideration and an appendix provides policy information relating to the Immigration Act (1987) and issues of domestic violence.
