The intention of the report is to give an overview of the number and types of cases heard in the Family Court and also a description of the characteristics of those who access the Court's services. The statistics presented are based on applications made to the Family Court in 2005. Additionally, some historical data are included to examine trends in Family Court activity for 1998 until December 2005. In section two of the report a number of statistics are presented which include: guardianship and Hague Convention, domestic violence, care and protection, relationship property, mental health, protection of personal and property rights, and adoption cases, requests for counselling, and dissolution of marriages and civil unions. Of all guardianship cases starting in 2005, 20% were cross-referenced with a concurrent domestic violence case; and of all the domestic violence cases starting in 2005, 47% were cross-referenced with a concurrent guardianship case; 71% of domestic violence cases starting in 2005 included children. The trend of commitments to domestic violence programmes in 2005 shows a continued decrease in numbers. Domestic violence cases appear to have stabilised after a few years of gradual decline. A surge in care and protection cases was noted. The report will inform policy making and public debate in relation to the Family Court. It will also provide a basis for more in-depth analysis of issues specific to the proceedings under each of the various Acts under the jurisdiction of the Family Court.
