Dispute resolution in the Family Court Boshier, Peter
Material type:
This article discusses the Family Court dispute resolution process and was presented at the LEADR Conference in 2007. A brief outline is given on the current situation concerning conciliation services followed by a discussion on the recommendations made by the Law Commission in their 2003 report "Dispute Resolution in the Family Court". The Family Courts Matters Bill was the result of this report and the suggested changes in the Bill are discussed, along with the author's ideas for the future. It is concluded that progress will be made in the alternative dispute resolution process by way of a nationwide non-judicial mediation service which would allow the Court greater resources to deal with cases requiring immediate judicial intervention.
