Summary, etc This research, commissioned by the Department for Courts, investigates why stipulated time frames for applications in the Family Court under both the Domestic Violence Act (1995) and the Children, Young Persons and Their Families Act (1989) are not always met. (There is a 42 day time period for the hearing of various applications under the Domestic Violence Act and a 60 day time period for the commencement of a hearing under the Children, Young Persons and Their Families Act for an application where a child or young person is in need of care and protection.) Data was gathered through interviews and group discussions with individuals in selected areas serviced by the Department for Courts. Eight Family Court judges, 24 Family Court staff, 3 Child, Youth and Family Solicitors, and 27 lawyers participated in interviews. It was concluded that the Family Courts vary in their ability to meet the specified timeframes, a major reason being that, in some areas there is insufficient court time available for hearings to be held within the designated period. Reasons for delays and the extent of these are examined, as well as suggestions for improvement. Limitations of the study are also discussed.
