Published in associaton with the Otago University Press Women's Studies Journal 14(1) 1998 : 131-143
This paper discusses the adequacy of the two legal defences of provocation and self-defence that are currently available to battered women who kill their abusers. It examines the question of why we have defences to murder, and looks at the principles underlying provocation and self-defence. A critical analysis of the use of battered woman syndrome in redefining existing defences is explored. The question of where the law should progress and whether defence law should undergo change is also considered.
