This NZ paper discusses the role of the Family Court in its response to domestic violence. It is suggested that improvements are needed in the implementation of the provisions of the various statutes that aim to protect people from violence. A call is also made to look at family violence from a pro-active perspective rather than dealing with it once it is already occurring. The problems associated with implementing a legislative response to domestic violence are traversed in some detail. Protections orders, the effect of violence on children and care arrangements, enforcement orders, and eliminating delay during the Court process are discussed. The goals of "The First Report" of the Taskforce for Action on Violence within Families (2006), in achieving an effective response to family violence, are also discussed.
